WAIVER AND RELEASE OF LIABILITY Company: Waitotara Valley Estate Ltd t/a Rumbling Adventures New Zealand (“RANZ”) Activity: Guided motorcycle tours and associated adventure activities (“the Activities”) Before You Ride At Rumbling Adventures, your safety is our top priority. These adventures take us through remote backroads, off-road terrain, and rugged South Island landscapes, the kind of riding that makes stories worth telling. Please take the time to read this form carefully. It explains the risks involved, what you’re responsible for, and how we’ll look after each other on the ride. If there’s anything you don’t understand, just ask. We’re happy to explain. 1. Understanding the Risks ☐ I understand that motorcycle riding - especially on gravel, off-road, or remote routes - carries inherent risks that can result in serious injury, death, or property damage. ☐ I acknowledge that these risks may arise from my own actions, the actions of others, environmental conditions, terrain, or mechanical failure. ☐ I understand that emergency services may be limited in remote areas. 2. My Health and Fitness ☐ I confirm that I have no physical or medical condition that would make it unsafe or medically inadvisable for me to participate. ☐ I am solely responsible for ensuring I am fit and capable of riding safely for the duration of the tour. 3. My Responsibilities as a Rider ☐ I will comply with the New Zealand Road Code and all relevant laws. ☐ I will ride within my own ability and follow the guidance of the RANZ Lead Guide and crew. ☐ I will operate the motorcycle safely, respect local road users and property, and avoid behaviour that endangers others. ☐ If I notice any fault or overheating in my motorcycle, I will stop immediately and notify the guide - failure to do so may result in loss of bond. ☐ I will not consume alcohol or drugs that impair judgment while riding or before any day’s ride. 4. Assumption of Risk I freely accept and fully assume all risks, hazards, and potential losses connected with my participation in the Activities, including any injury, illness, damage, or loss of property. I understand that RANZ cannot control all circumstances that may arise during the Activities. 5. Waiver and Release In consideration of being allowed to participate, I release and discharge RANZ, its officers, employees, contractors, agents, and representatives from any and all liability, claims, demands, or causes of action for any loss, injury, death, or damage that I may suffer arising from participation in the Activities, except where such loss is caused by the proven negligence of RANZ. 6. Indemnity I agree to indemnify and hold harmless RANZ from any and all claims or expenses (including legal fees) that result from my actions, negligence, or breach of this agreement while participating in the Activities. 7. Medical Treatment ☐ I consent to receive medical treatment in the event of accident, injury, or illness during or immediately after the Activities. ☐ I accept that such treatment will be at my own cost if not otherwise covered by insurance. 8. Insurance ☐ I acknowledge that it is my responsibility to arrange personal travel, medical, and cancellation insurance and that RANZ strongly recommends doing so prior to the Activities. 9. Governing Law This waiver is governed by and interpreted in accordance with New Zealand law, and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
